Terms of Use

These terms govern your use of this website and the Aviato driver portal. They are about the site. If you go on to drive with us, the relationship between you and Aviato is set by the agreement you sign — not by this page.

1. Who operates this site

This site is operated by AVIATO, LTD., a motor carrier running container drayage out of the Port of New York and New Jersey under its own authority — US DOT 3230286, MC 1012644. Reach us at aviato@aviato.us.

2. What this site is for

This site exists so CDL-A drivers can find out about driving with Aviato and apply, and so drivers we have invited can complete onboarding. It is not a load board, not a marketplace, and not a service you subscribe to.

3. Applying is not an offer, and pre-qualifying is not an offer

When you submit the application, the site runs an instant check against our minimum requirements and tells you the result. That check is a convenience, so you are not left waiting to learn you do not meet a floor. It is not a decision and it is not an offer.

Nothing on this site — a pre-qualification result, a portal invitation, a checklist that shows every item complete — commits Aviato to engaging you. An engagement begins only when both sides sign an agreement.

4. The information you give us has to be accurate

You agree that what you tell us is true and complete, and that the documents you upload are genuine and yours to provide.

This matters more here than on an ordinary web form. A driver application is a federal record under 49 CFR 391.21, and you will be asked to certify it. Falsifying it, or providing a document that is not yours, is grounds for us to stop the process at any stage and can carry consequences beyond us.

Please keep your contact details current while your application is open. If we cannot reach you, we cannot move you forward.

5. Your portal access

The driver portal is reached by a private link we send you. Treat that link like a key:

  • It opens your file. Anyone holding it can see what you have uploaded.
  • Do not forward it, post it, or let it be photographed over your shoulder.
  • Tell us at once if you think someone else has it, and we will issue a new one.
  • Links expire. If yours has stopped working, ask us for a fresh one rather than looking for a way around it.

6. Using the site properly

Please do not:

  • submit an application for someone else, or under a name that is not yours;
  • use a script, bot or automated tool against the application form or any part of the site;
  • try to reach another driver’s file, or any part of the internal dashboard;
  • probe, scan or test the security of the site — if you have found something, tell us instead (section 12);
  • upload anything containing malware, or anything you do not have the right to send us;
  • interfere with the site’s availability for anyone else.

We rate-limit the public form. If you hit a limit while doing something legitimate, wait a few minutes or email us — do not work around it.

7. Documents you upload

You keep ownership of everything you upload. You give us permission to store it, and to use it for evaluating your application, onboarding you, and meeting our recordkeeping obligations as a motor carrier.

We keep documents in private storage. How long we hold them, and the federal retention periods that decide that, are set out in our Privacy Policy.

8. Emails and texts

Applying means we will contact you about your application by email, and by text if you gave us a mobile number. Those are service messages about a process you started, not marketing. You can stop texts at any time by replying STOP; see section 4 of the Privacy Policy.

9. Using this site creates no engagement and no employment

Applying, being pre-qualified, receiving a portal link, or completing every item on a checklist does not by itself create any contractual, employment or engagement relationship between you and Aviato.

Aviato engages CDL-A owner-operators as independent contractors. For an owner-operator, the terms are in the independent contractor agreement you sign, and only there. You supply your own tractor, you carry your own insurance, you are free to haul for other carriers, and loads are offered to you — you decide whether to accept, at the rate offered. Declining a load carries no penalty of any kind.

Aviato also engages company drivers, on separate terms set out in the agreement applicable to that path.

Where these terms conflict with an agreement you have signed with Aviato, the signed agreement governs.

10. Availability

We try to keep the site up, but we do not promise it will always be available or error-free. We may change, suspend or withdraw any part of it. The site is provided “as is”, and to the extent the law allows we make no warranties about it.

If the site is down when you are trying to send us something time- sensitive, email recruiting@aviato.us — we would far rather hear from you than have you miss a deadline.

11. Limitation of liability

To the fullest extent permitted by law, Aviato is not liable for indirect, incidental, special or consequential losses arising out of your use of this website. Nothing in these terms limits any liability that cannot lawfully be limited, and nothing here affects rights you have under the Fair Credit Reporting Act or under federal transportation regulation.

12. Security reports

If you find a security problem, email aviato@aviato.us with enough detail to reproduce it. Please do not post it publicly first, and please do not access, alter or download anyone else’s data while investigating. We are a small operation and we read these.

13. Governing law

These terms are governed by the laws of the State of New Jersey, without regard to its conflict-of-laws rules. The courts of New Jersey have jurisdiction over any dispute about this website, except where a signed agreement between us says otherwise for matters it covers.

14. Changes

We may update these terms. The date at the top shows when they last changed. Continuing to use the site after a change means you accept the updated terms.
